1. Agreement to Terms
By accessing and using mslandscapingmd.com (the "Site") and by requesting our services, you accept and agree to be bound by the terms and provision of this agreement. Any participation in this service will constitute acceptance of this agreement. If you do not agree to abide by the above, please do not use this service.
2. Services and Consultation
MS Landscape provides premium design, hardscaping, and landscaping services. All estimates, consultations, and quotes provided through our web portal or contact forms are preliminary and do not constitute a legally binding contract for services. Final agreements outlining project scope, timeline, and exact financial terms will be drafted in a separate, written service agreement prior to the commencement of any physical work.
3. Intellectual Property Rights
The Site and its original content, features, photography, and functionality are owned by MS Landscape and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
4. Client Responsibilities
When requesting quotes or consultations, you agree to provide accurate and current contact information. Furthermore, any specific property permissions, structural layouts, and buried utility disclosures required for project ideation must be truthfully provided by the property owner during the drafting phase.
5. Limitation of Liability
In no event shall MS Landscape, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Site.
6. Governing Law
These Terms shall be governed and construed in accordance with the laws of Maryland, United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
